Terms of Service

1. Agreement to Terms

By accessing or using Inkfluence AI, Lead Magnet AI, or Cookbook Buddy (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Lead Magnet AI and Cookbook Buddy are offshoot applications of Inkfluence AI, and all services are operated under the same terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Inkfluence AI is an AI-powered book writing and publishing platform, Lead Magnet AI is an AI-powered lead magnet creation platform, and Cookbook Buddy is an AI-powered recipe and cookbook creation platform. Together, they provide:

• AI-assisted content generation and writing tools
• Chapter organization and project management
• Lead magnet, ebook, and cookbook creation tools
• Custom branding and design options
• Export functionality in multiple formats (PDF, DOCX, EPUB)
• Cloud storage and synchronization
• Premium features through paid subscriptions

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 13 years old to use this Service. If you are under 18, you must have permission from a parent or guardian.

3.3 One Account Per Person

Each individual may maintain only one free account. Creating multiple accounts to circumvent free-tier usage limits, monthly credit allowances, or any other restrictions is strictly prohibited. We may use technical signals (such as device fingerprints, IP addresses, and payment information) to detect duplicate accounts. If we determine that multiple accounts are operated by the same individual for the purpose of bypassing limits, we reserve the right to:

• Suspend or permanently terminate all associated accounts without notice
• Revoke any credits, generated content, or benefits obtained through the duplicate accounts
• Deny future account creation

This restriction does not apply to separate paid accounts maintained for legitimate business purposes (e.g. a personal account and a company account), provided each account is independently subscribed.

4. Content Ownership and Rights

4.1 Your Content

You retain all rights, title, and interest in the content you create using our Service, including:

• Books, manuscripts, and written content
• Characters, plots, and creative ideas
• Customized designs and branding
• Exported files and publications

4.2 License to Us

By using our Service, you grant us a limited license to:

• Store and display your content within the platform
• Process your content to provide AI-assisted features
• Create backups for data protection

4.3 AI-Generated Content

AI-generated suggestions and content are provided as tools to assist your writing. You are responsible for reviewing, editing, and ensuring the accuracy and originality of all content before publication or commercial use.

AI-generated content may occasionally contain factual inaccuracies, fictional information, or unintended similarities to existing works. You accept full responsibility for reviewing, editing, and verifying all generated content before publishing, distributing, or using it commercially. Inkfluence AI is not liable for any claims arising from content you choose to publish.

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Create or distribute illegal, harmful, or offensive content
• Generate discriminatory, hateful, violent, or deceptive content
• Harass, abuse, or harm other users
• Distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems
• Use our outputs to develop or train competing AI services
• Scrape, data mine, or use automated tools without permission
• Impersonate others or misrepresent your identity
• Use the Service for spam or unsolicited marketing
• Direct abuse, harassment, threats, or intimidating behaviour towards Inkfluence AI staff, support channels, or other users
• Systematically scrape, crawl, or harvest content from public pages (including /books) for the purpose of building datasets, training AI models, or reproducing content in bulk

We may review or monitor activity for violations of this policy. We reserve the right to remove content, suspend or terminate accounts, and report unlawful activity to authorities when we have reasonable grounds to believe the Service is being misused.

6. Public Showcase (/books)

The Inkfluence AI Public Showcase allows users to publish their books for public viewing. By publishing content to the Showcase, you agree to the following additional terms:

6.1 Content Standards

Content published to the Showcase must NOT contain:

• Sexually explicit, pornographic, or NSFW material
• Graphic depictions of violence, gore, or torture
• Content that sexualises minors in any way
• Hate speech, slurs, or content promoting discrimination based on race, ethnicity, gender, sexual orientation, religion, or disability
• Content that promotes terrorism, self-harm, or violence against identifiable individuals or groups
• Plagiarised, pirated, or copyright-infringing material
• Spam, SEO-stuffed, auto-generated gibberish, or purely promotional content with no substantive value
• Personally identifiable information (PII) of third parties published without their consent

6.2 Quality Standards

We aim to maintain a useful, high-quality Showcase for all visitors. Content that is substantially unfinished, incoherent, or of very low quality may be subject to review and removal at our sole discretion. Examples include but are not limited to:

• Books consisting largely of placeholder or test text
• Duplicated content published multiple times
• Content that appears to be an unedited raw AI dump with no meaningful human review or curation

6.3 Review and Removal

Inkfluence AI may remove or restrict access to any Showcase content at its sole discretion, with or without notice, for any reason, including but not limited to violation of these content standards or quality guidelines. We are not obligated to review content before or after publication. Repeated violations may result in permanent loss of Showcase publishing privileges or account suspension.

6.4 Reporting Content

If you encounter Showcase content that violates these standards, please report it to hello@inkfluenceai.com with a link to the content and a brief description of the concern. We will review all reports promptly.

7. Subscription and Payments

7.1 Free Plan

Our free plan includes limited features with usage restrictions. We reserve the right to modify free plan limits at any time.

7.2 Premium Subscriptions

• Subscriptions are billed monthly or annually
• Payments are processed securely through Stripe
• All fees are in USD ($) unless otherwise stated
• Subscriptions auto-renew unless cancelled
• Price changes will be communicated 30 days in advance.

7.3 Refunds

Subscriptions are non-refundable once any AI generation, content export, download, or audiobook creation has been used during the billing period. If you experience a billing issue and have not used the Service during the current billing period, please contact hello@inkfluenceai.com within seven (7) days of the original charge so we can investigate. We will provide refunds where required by law and may offer a courtesy refund when platform downtime materially prevents use of the Service. We do not issue refunds for partially used billing periods, consumable chapter credit packs once any credits have been used, or renewal payments when cancellation occurs after the renewal date.

7.4 Cancellation

You may cancel your subscription at any time. Access to premium features continues until the end of your billing period.

7.5 Chargebacks

You agree to contact us before initiating a chargeback so we can resolve the issue together. Filing a dispute without prior notice may result in temporary suspension of your account while the matter is reviewed. We reserve the right to recover chargeback fees or outstanding balances using the payment method on file or by invoicing you directly.

8. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free access
• That the Service will meet your specific requirements
• That data loss will never occur (always maintain backups)
• Availability during maintenance or emergencies

9. Termination

9.1 By You

You may delete your account at any time through your account settings.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay subscription fees

10. Disclaimer of Warranties

11. Limitation of Liability

In any event, our aggregate liability for claims arising out of or related to the Service will not exceed the greater of (a) the total fees you paid to Inkfluence AI in the twelve (12) months preceding the event giving rise to the claim or (b) $100. Some jurisdictions do not allow limitations of liability, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Inkfluence AI and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through:

1. Good faith negotiation between parties
2. Mediation if negotiation fails
3. Binding arbitration if mediation fails

16. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence and is provided for informational and creative purposes only. AI-generated output:

• May contain factual inaccuracies, outdated information, or unintended errors
• Does not constitute professional advice of any kind, including but not limited to legal, medical, financial, tax, or therapeutic advice
• Should be independently verified by you before publication, commercial use, or reliance
• May inadvertently resemble existing published works — you are solely responsible for ensuring your content does not infringe third-party rights

Inkfluence AI makes no representation or warranty regarding the accuracy, completeness, originality, or fitness for purpose of any AI-generated content. You acknowledge that you are the publisher of any content you export or distribute and accept full responsibility for it.

17. Third-Party Services

The Service relies on third-party providers to deliver certain functionality, including but not limited to:

• OpenAI — AI content generation
• ElevenLabs — Text-to-speech audiobook generation
• Stripe — Payment processing
• Firebase (Google Cloud) — Authentication, data storage, and hosting

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. In the event a third-party provider changes its policies, experiences downtime, or discontinues a feature, we will make reasonable efforts to find alternatives but are not liable for any resulting disruption to the Service.

18. Data Portability

You may export your content at any time using the export features provided within the Service (PDF, DOCX, EPUB). If you delete your account, we will make reasonable efforts to allow you to export your data beforehand. After account deletion, your data will be removed in accordance with our Privacy Policy.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government actions, power outages, internet or telecommunications failures, cyberattacks, or the failure of third-party service providers (such as AI model providers, cloud hosting, or payment processors).

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
